The data management system allows the Company to provide improved recommendations to patients who use the Company's devices and mobile applications. · to prepare and send you (if you consent) marketing information that may be tailored based on the data you have uploaded (including whether you have type 1 or type 2 diabetes) or data associated with your account on Hematonix data management system (including monitoring results, alerts, login data and events);
· to contact you to learn more about your use of the Hematonix data management system or application ;
· to troubleshoot technical problems when you provide us with data related to diagnosis, troubleshooting, including health information, and for broader analysis to identify system problems;
· to assist in performing performance analysis of the Hematonix application . Performance monitoring data may include application version, country, OS level, device, radio, and mobile carrier information. This information does not include your medical device serial number or other personal information, including health information ;
· Hematonix application usage data with data such as monitoring results, alerts, login and event data, purchase information from our Hematonix web stores , statistical information about the number of calls you make to our customer service departments and statistical information about educational and marketing materials sent to you, and use this combined information for the following purposes: to provide you with personalized services in the form of sending you information that is relevant to you; for a more complete understanding and more effective interaction with you; to understand your preferences, optimize your experience and provide you with content, products and promotions that may be of interest to you; to gain insight into the preferences and behavior of our customers after aggregating, anonymizing or anonymizing your personal data.

You can share information with a healthcare provider by allowing your profile to be connected to their Hematonix Data Management System professional user account or by using the data transfer feature in the Hematonix app . Using the data transfer feature in the Hematonix app , you can send reports of your personal data and glucose readings to your healthcare provider. If your healthcare provider has created a professional user account in the Hematonix data management system , they can use it to create medical profiles organizations, patients and connecting a patient profile to your account in order to view and print reports, as well as view them remotely and transfer them to other specialists in your medical institution.
5.5. We may disclose your personal information to your health care provider in accordance with our Privacy Policy. The User may disclose his own personal data to the attending physician or third parties using the functionality of the Site, Application or Data Processing System. Health care professionals who provide health care services to you may also have access to your personal information for the purpose of providing health care or services to you. In the event that the User discloses personal data to third parties, the Company is not responsible for their further use and security.
5.6. If you give your healthcare provider access to your Hematonix data management system or application account , or your healthcare provider creates a Hematonix data management system account for you , the Company will process your personal data on behalf of your healthcare provider for protect your vital interests and health as directed by your healthcare provider. The Company will process your personal data, including health data, as a “data controller” for the purposes of providing you with medical care to protect your vital interests and health, and in such cases, your healthcare provider will be the data controller of your personal data.
5.7. Your healthcare provider can also create an account in the Hematonix data management system or app and create patient profiles from that account. When you visit your healthcare provider, they can connect your device to their data management system or Hematonix app account to view and print patient reports, as well as remotely view and share them with other providers. Data Management System and Hematonix Application allows patient users to create accounts, upload their own information, and share it with professional users. This allows professional users to view patient reports remotely and share them with other specialists in their healthcare facility. Your healthcare provider can use the Hematonix data management system to send patient reports directly to their electronic health record systems.
5.8. The Company may use personal information, including health information, where required by law. As a supplier of medical devices, the Company has certain legal obligations to ensure the continued safety of its medical products. This may require the Company to provide personal information to regulatory authorities responsible for the quality and safety of medical devices (for example, when your healthcare provider notifies us of an adverse incident involving a Hematonix product ). The information that Company may be required to provide is not used to identify you by name or email address, unless we are legally obligated to include this information—for example, when a health care provider files a complaint or reports an adverse incident. The Company may use such data for the following purposes:

· to monitor and improve the quality, safety and effectiveness of medical devices and systems;

5.9. The Company conducts product usage research based on de-identified, anonymized, aggregated and/or de-identified data for limited purposes, including, among other things, to better understand the functionality of the Hematonix application , problems associated with these applications that may require solutions, as well as the number of application downloads from application stores.
This data includes limited demographic data, such as year of birth and country of residence, as well as device-specific data (such as frequency and number of days of sensor use, glucose targets, average glucose values, insulin data, prandial profiles, exercise log data, load and other logs, information generated by the sensor, such as information about when you started and stopped using the sensor, information about turning Bluetooth connection on and off (as applicable), information about whether you viewed the glucose data you uploaded to the Data Management System Hematonix ). This information may also include data obtained from your third-party connected devices or applications, as well as your responses to research surveys. Anonymized data is no longer subject to data protection and privacy legislation. The data processed for research purposes does not include your name, residential address, telephone number or email address. The Company maintains this set of de-identified, anonymized, aggregated or anonymized data in a secure manner and will not be used to identify you by name or email address. If you delete your account through the settings in the data management system or the Hematonix application or through a request to Customer Service, data that has been, or is in the process of being, translated into an anonymous, de-identified, anonymized and/or aggregated form for research purposes in the manner described in this section will not be deleted. The Company may use such data for the following research purposes:
· to create data, access data, store, use and transmit data to our affiliated companies, third party researchers, medical institutions, healthcare providers or public health authorities for the purposes of scientific research, statistical compilation and other analysis;

· to conduct research, development, testing and management of health care delivery systems;
· to conduct research, development and testing of medical devices, including new and existing functionalities and capabilities, for the purposes of product development and scientific research through statistical analysis and other analysis methods, and conducting surveys.
5.10. Once you register an account with the Hematonix Data Management System , your account profile information is stored in a database that contains your health information . Please note that your name and health information are combined when you use the data sharing feature to report your glucose data to a health care provider or other third party, and when your health care provider requests that to have the Hematonix data management system report your glucose data directly to the health information system it uses .
6.1. The Company takes reasonable precautions to protect Personal Information from loss, theft, misuse, unauthorized access or disclosure, alteration or destruction. Any personal information provided to us by the Client will be treated as confidential and shared only within the Company and its Partners and will not be disclosed to third parties except as part of any regulatory or legal proceedings.
6.2. The Company uses physical, electronic and procedural safeguards to protect Personal Data and does not retain Personal Data longer than is necessary to provide the Service or permitted by law.
6.3. The Company guarantees that the information provided by Users is not combined with statistical data, is not provided to third parties and is not disclosed, except as provided in the Policy.
6.4. To protect your personal information, including health information, from unauthorized or unlawful access, accidental loss, destruction, damage, misuse, disclosure and alteration, including through the use of cryptographic technologies, we have implemented administrative, technical and physical security measures.

· Hematonix medical products transmit personal glucose data to mobile apps and devices using technology and Bluetooth. Bluetooth is a secure means of transferring data between devices. Bluetooth connections for Hematonix sensors are established through an encrypted communication session between the sensor and the Hematonix mobile app .
6.5. To ensure the protection of personal data, the Company may use two-factor authentication when logging into the application and registering an account in the data management system or the Hematonix application . To authenticate as a user of your account, you may provide your phone number, email address, or other means.
6.6. To ensure uninterrupted operation of your products , please be aware that the Hematonix website, data management system or application may not be available during scheduled maintenance sessions.
6.7. You are responsible for ensuring that your data management system account and the Hematonix application and devices are protected from unauthorized access. We recommend securing access as follows:
· always log out;
· choose a complex and strong password for your account in the Hematonix data management system , not known to anyone except you;
· use the security settings on your mobile device or computer, for example by setting a password to access it;
· lock your device when not in use;
· Keep your account information and password confidential.
The Company is not responsible for lost, stolen or hacked passwords, or for any actions by unauthorized users in relation to your account in the data management system or the Hematonix application , if this is your fault. If you believe your account has been hacked, please contact us as soon as possible.
6.8. The Company's data centers contain both internal and external servers. Access to the Company's internal server is limited to pre-approved individuals, servers and locations; Our external servers can be accessed via the Internet.
6.9. The Site Administration takes technical and organizational measures to provide the User with information regarding the processing of his personal data, including providing, upon the User’s request:
· confirmation of the fact of processing of personal data by the Site Administration;
· legal grounds and purposes of processing personal data;

· information about the completed or intended cross-border transfer of personal data;
· name or surname, first name, patronymic and address of the person processing personal data on behalf of the Site Administration, if the processing has been or will be assigned to such a person;
· other information provided for by Federal Law No. 152-FZ of July 27, 2006 “On Personal Data” or other federal laws.
6.10. If the Company does not provide the Client with a response within 8 weeks of the Client's request, the Client has the right to lodge a complaint.
6.11. We note that the Company may refuse to provide information to the Client in accordance with the provisions of this paragraph if it would jeopardize an investigation or trial in a criminal case or if it would jeopardize political, financial and tax stability.
6.12. The Company has the right to provide information about Users to law enforcement agencies or other government agencies as part of a trial or as part of an investigation based on a court decision, as well as in other cases provided for by Russian legislation.
6.13. If you would like to delete your account from the Hematonix data management system or application , you can do so by logging into your account and using the delete account feature.
· Please note that if you delete your account, all account data in the data management system will be deleted, but we will retain data that has been or is in the process of being translated into an anonymous, de-identified, de-identified and/or aggregated form for purposes described in section 5.
· We may also retain some personal data where required by law. Once your account is deleted from the Hematonix data management system or application , you will no longer have access to that system. The account deletion operation is irreversible. 7.1. The Company may transfer Personal Data to third parties for the purposes described in this Policy. In such cases, Company uses commercially reasonable efforts to ensure that third parties:
· have signed privacy standards similar to this Policy or agreed in writing to comply with these standards; or
· are bound by laws that provide at least the same level of privacy protection as contained in this Policy.
7.2. The Company may disclose Personal Data to third parties for the purpose of statistical analysis of data in aggregated and anonymized formats.
7.3. The Company has the right to conduct statistical and other studies based on anonymized information provided by the User. The Company has the right to provide access to such research to third parties for advertising targeting.
7.4. The Site Administration has the right to provide information about Users to third parties to identify and suppress fraudulent activities, to eliminate technical problems or security problems.
